Clear Valuation Terms of Service (ToS)

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," whether as an individual or an entity) and Clear Valuation Inc. ("Company," "we," "us," or "our") governing your access to and use of:

  • Our website located at www.clearvaluation.com;

  • Any related media, mobile applications, platforms, or communication tools;

  • Any appraisal-related services, products, reports, booking systems, downloads, or other offerings (collectively, the "Site" and "Services").

We are a licensed appraisal firm incorporated in Nevada, with operations in both Nevada and Florida. By using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, do not access or use the Site or Services.


2. Updates to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be reflected by updating the "Last Updated" date above. Continued use of the Site or Services after changes have been posted constitutes your acceptance of the new Terms. It is your responsibility to periodically review these Terms for updates.


3. Eligibility and User Representations

By using the Site, you represent and warrant that:

  • You are at least 18 years old.

  • You have legal capacity to enter into this agreement.

  • Your use of the Site and Services complies with all applicable laws, including real estate and appraisal laws in Nevada and Florida.

  • You will not access the Site through automated or non-human means.

  • All information provided to us is true, accurate, and current.


4. Intellectual Property Rights

All content on the Site, including text, graphics, logos, designs, software, and trademarks ("Content"), is owned by or licensed to Clear Valuation Inc. and is protected under United States copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site and download or print portions of the Content solely for personal, non-commercial use.

You may not:

  • Copy, distribute, modify, or create derivative works from the Content;

  • Use our trademarks without prior written consent;

  • Use the Site or Content for any commercial purpose not authorized in writing by us.


5. Appraisal Services

All appraisal services are conducted in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP), as well as state-specific laws and guidelines issued by the Nevada Real Estate Division and the Florida Real Estate Appraisal Board. Our services include but are not limited to:

  • Mortgage lending appraisals (conforming with FIRREA);

  • Private-use appraisals such as estate, date of death, divorce, tax appeal, and charitable donations (conforming with IRS guidelines and federal law);

  • Exterior-only and desktop appraisals where allowed by regulation.

Appraisals are based on market conditions and property information as of the effective date and are intended solely for the stated use and user outlined in the engagement letter.


6. Payment Terms

We accept major credit/debit cards, PayPal, and other payment processors listed on our Site. All payments must be made in U.S. dollars. You agree to provide accurate and up-to-date billing information and to pay all applicable charges, including sales tax, if required.

Appraisal fees are due in advance unless otherwise specified in writing. We reserve the right to suspend delivery of services until payment is received.


7. Privacy and Data Security

By using the Site or Services, you agree to our Privacy Policy. We collect, store, and use your data in compliance with federal privacy laws including the Gramm-Leach-Bliley Act (GLBA), the FTC Safeguards Rule, and state-specific privacy regulations.

When working on mortgage-related appraisals, we receive non-public personal information (NPI) from lenders or AMCs, which we handle with strict confidentiality. For private-use appraisals, we collect only what is necessary to complete the appraisal and do not share it with third parties without written permission.


8. Prohibited Conduct

You agree not to use the Site or Services to:

  • Violate any local, state, or federal law;

  • Misrepresent facts, submit false orders, or use false identities;

  • Upload viruses or engage in cyberattacks;

  • Interfere with or disrupt the Site, including using bots, scrapers, or automated tools;

  • Access content not intended for you;

  • Copy, reverse engineer, or decompile any part of the Site.

We reserve the right to suspend or terminate your use of the Site if you engage in prohibited conduct.


9. Limitation of Liability

To the maximum extent permitted by law, Clear Valuation Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from or related to your use of the Site or Services.


10. Indemnification

You agree to defend, indemnify, and hold harmless Clear Valuation Inc. and its officers, employees, agents, and affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Services, violation of these Terms, or infringement of any third-party rights.


11. Dispute Resolution

These Terms are governed by the laws of the State of Nevada. Any disputes arising under or related to these Terms shall be resolved in the state or federal courts located in Clark County, Nevada. In cases where arbitration is elected, it will be conducted through the American Arbitration Association in accordance with its Commercial Arbitration Rules.
